PRIVACY

1. What means what

In this Policy:

"personal information" means any information or opinion about a living natural person (whether or not true), including information that can reasonably be used to identify a specific natural person;

"we," "us," "our," and "IIII London" are references to Four Eyes London Ltd and its related companies from time to time; and "you" and "your" means a natural person whose personal information we have collected.

3.1 We collect personal information in a number of ways, including:

(a) where you provide information directly to us, including through our website or when you participate in promotions or competitions run by us;

(b) where you interact directly with our employees and such other persons acting for us or on our behalf, such as our customer service team, including from electronic queries sent to us via email;

(c) where you provide information directly to us during a recruitment process;

(d) from third parties, such as our service providers;

(e) through referrals from individuals or other entities;

(f) through marketing and business development events;

(g) where you provide feedback to us;

(h) from related entities in our corporate group; and

(i) from publicly or commercially available sources of information.

 

3.2  If you do not wish for your personal information to be collected in a way anticipated by this Policy, we will use reasonable efforts to evaluate your request. If we do comply with your request, or you choose to not provide your personal information to us, or you provide us with inaccurate or incorrect information, we may not have sufficient information to conduct our business and we may be limited:

(a) in our ability to properly conduct our operations, including providing products and services to you;

(b) in our ability to keep you informed about your orders or our business;

(c) in considering your application for employment with us; and

(d) in our ability to respond to an inquiry or request.

3.3 As part of our operations we collect personal information.  The specific personal information that we may collect or hold will depend on the context in which we collect it, and may include your name, telephone or mobile phone number, addresses, banking details, credit card information, tax file number, details of transactions you conduct through our website or through other channels and of the fulfilment of your orders, information about your eyeglass prescription, and any other personal information you or a person ostensibly authorized by you submits to us, as well any other information that we consider necessary (such as information about your opinions) to perform our functions and activities (which may include details of your visits to our website and information collected through cookies and other tracking technologies including your IP address and domain name, your browser version and operating system, traffic data, location data, web logs and other communication data, and the resources that you access).

4. Types of information we collect and share

These data are provided spontaneously by visitors to take advantage of the interactive activities offered by the Site.  In particular, Four Eyes London may request personal information in some sections of the site, such as name, surname, date of birth, email address, etc. This may happen, for example, if you require to receive newsletters. We may also collect personal information from our users on third parties, for example where the Site allows the user to send an email to direct someone to our site or send them an active promotion. In this case, we will know the name and e-mail address of the recipient and the user who has provided them declares to have obtained the necessary consent from the recipient.

 

4.1 This information will only be used for the intended purpose (sending e-mail) and Four Eyes London will not contact third parties any further unless they contact us.

Except where not otherwise indicated, the personal data supplied will be used exclusively to manage and respond to the requests of the user/visitor, thus constituting the contractual and pre-contractual implementation of this processing.

In each of the above-mentioned sections of the Site where personal data are collected for each different purposes, there are specific Privacy policies explaining the details of the processings, as well as any requests for consent to the processing of personal data for marketing and even profiled purposes (for more details click here), for which the specific consents are the legal basis of the processings.

4.2 The user/visitor is in any case asked to refrain from entering special categories of personal data, i.e. those that reveal racial or ethnic origin, political opinions, religious or philosophical convictions, or union membership, as well as processing genetic data, biometric data intended to uniquely identify a natural person, data related to the health or sex life or sexual orientation of the person, since they cannot be treated further without consent and must be eliminated.

In conducting our operations, we may share some of your personal information with, or receive personal information from, third parties such as outsourced service providers and contractors. Unless you have agreed otherwise, these parties are not allowed to use your personal information for any other purpose except to assist in conducting our business. We take reasonable steps to ensure that such third parties are subject to confidentiality requirements and to obligations to process personal information in compliance with the same safeguards that we deploy. In particular, we may disclose your personal information:

(a) to third party technology providers including Wix, Paypal and Stripe which are online solutions we use to process customer orders and manage internal human resource functions;

(b) to couriers and other logistics service providers to deliver products and services to you;

(c) through Electronic Data Interchange (EDI);

(d) in the case of employees, to third parties that manage our payroll system;

(e) to any other third parties carrying out our functions;

(f) to other service providers or referral partners in order to provide our services to you, or to assist our functions or activities (such as law firms);

(g) where you otherwise provide your consent, whether express or implied; and

(h) where otherwise required by law.

 

4.3 From time to time, we may transfer your personal information to overseas recipients (including our related companies and any relevant third parties) if it is necessary to conduct our business.  We currently have operations in Australia, the United States and Europe and personal information is disclosed to recipients in those jurisdictions. We also use cloud-based solutions such as Shopify, NetSuite and EDI that store personal information securely primarily in the United States and Europe. We may from time to time expand our operations and/or change the cloud-based or other solutions used to store personal information.

 

We take reasonable steps to ensure that our service providers provide commitments relating to privacy and confidentiality which require the service provider to limit its use of your personal information and to protect your personal information against misuse, loss and unauthorized access.  Where you are based in the UK or elsewhere in the European Economic Area (EEA), and we transfer your personal information outside of the EEA, we will impose the same data protection safeguards that we deploy inside the EEA on applicable third parties.

This policy shows the methods and purposes of the processing carried out by Four Eyes London.

 

Four Eyes  London care deeply about the privacy of its visitors and users. To that end, this Privacy Policy (“Privacy Policy”) describes how Four Eyes London Ltd., together with its affiliated companies worldwide (“Four Eyes”, “IIIILondon”, “our”, or “us”), collect, use, and share your Personal Information, as well as an explanation of the data rights you may have in regards to personal information.

The registered Data Controller, of the personal data of the subjects involved in respect of the browsing of the website  http://www.iiiilondon.com (“Site”) on the occasion of your access to the Site, as well as the necessary information about your rights and how to exercise them.

We do not, and will not, sell any of your personal data to any third party – including your name, address, email address or credit card information. We want to earn and maintain your trust, and we believe this is absolutely essential in order do that.

However, we share your data with the following categories of companies as an essential part of being able to provide our services to you:

  • Companies associated with the Four Eyes London network, as sometimes different bits of our group are responsible for different activities

  • Companies that do things to get your purchases to you, such as payment service providers, warehouses, order packers, and delivery companies

  • Professional service providers, such as marketing agencies, advertising partners and website hosts, who help us run our business

  • Affiliates who help us reach out to potential new customers or promote our products on their websites

  • Credit reference agencies, law enforcement and fraud prevention agencies, so we can help tackle fraud

You may choose to take advantage of some of our additional services, in which case, depending on your choices we may share your data with the following categories of companies to fulfil the services you have asked for:

  • Social Media sites (for example if you choose to link your accounts to us) and other companies approved by you

  • Product size and fit advisors to help you choose the right products

  • Marketplace sellers where you place a Marketplace order; and

  • Other third party payment providers, when you choose to use their payment services

Kind of the data provision and consequences of refusal.

The provision of personal data above by users/visitors is automatic (therefore, mandatory) in the case of browsing the site for navigation data, optional for data provided voluntarily (see the Cookie Policy for cookies). However, failure to give optional data, in the case of those with an asterisk, will result in the impossibility of being able to enjoy certain functionalities of the Site and the requested activities. Instead, failure to give your consents to the use of your data by Four Eyes London for the purposes of profiled and/or generalized direct marketing will not affect in any way the functionalities of the Site and the requested activities, but will not allow Four Eyes London to transmit you the marketing communications referred to above.

Processing methods and subjects who may have access to data.

Your personal data are processed with electronic instruments for the time necessary to achieve the purposes for which they were collected.  They are processed in compliance with the applicable legislation, adopting the appropriate and most suitable security measures aimed at preventing unauthorized access, disclosure, modification or unauthorized destruction.

Your data will be processed by Four Eyes London employees or collaborators, specifically trained on the treatment and any digital service providers appointed as data controllers.

Data may be communicated, subject to release of your optional and specific consent, to Four Eyes London who will use them for its profiled marketing purposes but will not be disclosed to other third parties except for legal obligations or judicial authorities and will not be disseminated in any way.

Processing of personal data outside the European Economic Area (EEA)

All of your data will be processed by Four Eyes London in London, United Kingdom with appropriate safeguards, as required by the Data Protection Regulation  (hereinafter also referred to as "GDPR").

6. Storage, security, and retention of personal information

6.1 Where we hold your personal information, we will take reasonable steps to ensure that the information is secure and may only be accessed by authorized persons. Please notify us immediately if you believe there has been any unauthorized access to your information.

6.2 Although we take reasonable steps, we do not control how a third-party partner may use your data. Please note that third party recipients of personal information may have their own privacy policies and we are not responsible for their actions, including their handling of personal information.

6.3 We keep personal information as long as it is reasonably necessary for the purposes described in this Policy or otherwise in compliance with our or our service providers’ data retention policies.  Certain information may be retained until the time limit for any legal challenges has expired or in order to comply with regulatory requirements regarding the retention of such personal information. 

 

6.4 If you have provided us with personal information in the course of applying for employment with us, and your application has not been successful, we may keep your personal information in case a suitable role becomes available.  Where applicable, if any personal information that we hold is no longer required for the purpose for which it was collected and no applicable law requires us to retain that information, we will take reasonable steps to de-identify or destroy the information.

7. Direct Marketing

7.1 From time to time, we may use your personal information for direct marketing purposes (for an indefinite period).  Where required by law, we will ask for your consent before conducting any of these types of marketing.  This includes sending you updates about our products and offerings. When we contact you, it may be by mail, telephone, email or SMS. SMS may be sent using an automatic telephone dialing system. Consent for SMS is not required as a condition to purchase products or services. Message and data rates may apply.  Where we use or disclose your personal information for the purpose of direct marketing, we will:

(a) inform you if we intend to use your information for such purposes;

(b) allow you to ‘opt out’ or, in other words, allow you to request not to receive direct marketing communications; and

(c) comply with any such request by you to ‘opt-out’ of receiving further communications within a reasonable time frame.

7.2  We will provide an option to unsubscribe or opt-out of further communication on any electronic marketing communication sent to you.  You may ask to be removed from our marketing lists at any time by clicking the unsubscribe link or by directly contacting us.  If you don't wish to receive direct marketing materials, contact our Privacy Officer using the details set out at the end of this Privacy Policy.

If you have said we can, we’ll send you marketing messages to keep you aware of what we’re up to and to help you see and find our products and services. 
 

7.3 How to stop marketing messages from Four Eyes London

You can control the marketing communications you receive from us through the Contact Preferences section of your Four eyes London account. You also have the following options: 

  • Emails:  You can also click on the ‘unsubscribe’ link in any marketing email you receive, and this will take you to the Contact Preferences section of your account so you can unsubscribe from that method of communication. 

  • Text Messages:  You can also text “stop” to the number provided within the communication and this will unsubscribe you from that method of communication. 

  • Any method of Marketing:  You can contact our team. Once you do this, we will update our records to ensure that you don’t receive further marketing messages. 

 

If you tell us you don’t want to receive marketing messages it might take a few days for all our systems to be updated, so we would ask for your patience as you might get messages from us while we process your request. 
Please note that opting out of marketing messages will not stop service communications, such as order updates, or where you have asked for a specific ‘back in stock’ notification.

You have a lot of rights relating to your personal information, these are:

  • The right to be informed about how your personal information is being used (like this notice!)

  • The right to access the personal information we hold about you

  • The right to request the correction of inaccurate personal information we hold about you (although you can probably do most of this through My Account

  • The right to request that we delete your data, or stop processing it or collecting it, in some circumstances

  • The right to stop direct marketing messages, which you can do through My Account

  • The right to withdraw consent for any consent-based processing at any time

  • The right to request that we transfer or port elements of your data either to you or another service provider

  • The right to ask us to explain any computer-system decision about you

  • The right to complain to your data protection regulator — in the UK, the Information Commissioner’s Office

It will be possible at any time to exercise access to your personal data, correct, integrate or delete them or request the limitation of processing that concerns the ones pending correction or the end necessary to protect the rights, object to the processing, revoke the consents given, and also obtain (in case of consent to the processing) the release, in electronic form, to you or to another person indicated, of the personal data provided, sending a written request to the e-mail address info@iiilondon.com
